Withdrawal from a distance contract
1.The Consumer and the Customer-Consumer have the right to withdraw from the contract concluded at a distance without giving any reason and without incurring any costs, except for the costs indicated in the following section of the Terms and Conditions.
2.The term for withdrawal from the distance contract is 14 days, counting from the day after the Consumer or the Customer-Consumer or a third party indicated by him other than the carrier, in possession of the purchased products.
3.Where the contract covers a number of goods which are delivered separately, in lots or in lots, the withdrawal period shall be calculated from the date of taking possession of the last good, lot or part thereof and, where the contract consists in the regular delivery of goods for a specified period, from the date of taking possession of the first of the goods.
4.The Consumer or the Customer-Consumer is responsible for the decrease in the value of the product resulting from its use in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the product.
5.The declaration of withdrawal from the contract can be sent to the Seller’s e-mail address: info@biobe.eu.
6.The Consumer or the Customer-Consumer may use the model withdrawal form provided by the Seller or use Annex No. 2 to the Act of 30 May 2014 on Consumer Rights.

7.The Consumer or the Client-Consumer may also draw up a letter of withdrawal from the agreement in his own hand, stating:
a) Identification and address data of the Consumer or Client-Consumer,
(b) the name or symbol of the returned products,
c) the date of receipt of the products by the Consumer or the Client-Consumer,
d) Bank account number or other way of refunding the costs of the products by the Seller.
8.The Seller shall immediately send the Consumer or the Customer-Consumer a confirmation of receipt of the statement of withdrawal from the agreement to the e-mail address provided by him.
9.In the event of withdrawal from the agreement, the agreement shall be deemed not to have been concluded.
10.In accordance with Article 38 of the Act of 30 May 2014 on Consumer Rights, the Consumer and the Customer-Consumer are not entitled to withdraw from the contract:
a) the provision of services, if the trader has fully performed the service with the express consent of the consumer, who has been informed before the start of the service that after the performance of the service by the trader will lose the right of withdrawal;
(b) where the price or remuneration depends on fluctuations in the financial market over which the trader has no control and which may occur before the expiry of the withdrawal period;
c) where the subject of the service is non-prefabricated goods, manufactured according to the specifications of the consumer or serving to meet his individual needs,
d) where the subject of the service is goods which are perishable quickly or have a short shelf life;
e) where the subject of the service is the goods delivered in sealed packaging, which after opening the packaging cannot be returned due to health protection or hygiene reasons, if the packaging has been opened after delivery;
f) in which the subject of the service are things which, after delivery, due to their nature, are inseparably connected with other things;
g) the supply of digital content that is not stored on a tangible medium, if the performance of the service commenced with the express consent of the consumer before the expiry of the withdrawal period and after the trader has informed him of the loss of the right of withdrawal.

SHIPMENT
The registered parcel will be dispatched on the delivery date indicated on the shipping confirmation or, if no delivery date is specified, within 14 days from the shipping confirmation date, except in exceptional circumstances.

COMPLAINT

1.In the event of non-conformity of the goods with the contract within 2 years from the date of delivery of the goods to the Consumer and the Customer-Consumer has the right to demand replacement or repair of the goods, and in the event of impossibility or refusal to bring the goods into conformity with the contract, to demand a price reduction or to withdraw from the contract of sale of the goods.
2.Complaints can be submitted in any form. For evidentiary purposes, the Seller recommends that complaints concerning the goods be sent in writing or by e-mail to the Seller’s e-mail address.
3.Each complaint should include at least:
(a) name, address, postal code,
b) the name of the purchased goods,
c) a description of the complaint,
d) the date of disclosure of the non-conformity of the goods with the contract.
e) Confirmation of purchase from the Seller (depending on the circumstances, you can provide one of the following: proof of purchase, order number, payment confirmation, e-mail confirming receipt of the order by the Seller, etc. )
4.The Seller shall consider the complaint immediately, at the latest within 14 days from the date of its receipt, by sending a reply to the address indicated by the Consumer or the Customer-Consumer, including the e-mail address, enabling him to familiarize himself with the position of the Seller.

5.The non-conformity of the goods which became apparent within two years from the date of delivery of the goods shall be presumed to have existed at the time of delivery, unless proven otherwise or the presumption cannot be reconciled with the specific nature of the goods or the nature of the non-conformity of the goods.
6. The Seller shall repair or replace it within a reasonable time from the moment when it was informed by the Consumer or the Customer-Consumer about the lack of conformity with the contract, and without undue inconvenience for the Consumer or the Customer-Consumer, taking into account the specificity of the goods and the purpose for which the goods were purchased.
